This page sets out our general terms and conditions under which the products offered for sale on our webshop www.rubiomonocoat.be are offered and delivered to you. Please read these General Terms and Conditions carefully before ordering our Products online. By completing the online ordering process, you agree to be bound by them.
1. Identity of the Seller – Customer Status
The Products are sold to you by:
Muylle-Facon BV
Registered Office: Ambachtenstraat 58, 8870 Izegem, Belgium
CBE Number: 0607.980.657
VAT: BE0782268772
Any natural person placing an order via the Seller's webshop outside their business activity is referred to in these General Terms and Conditions as the "Customer".
2. Applicability
These General Terms and Conditions apply to all offers from the Seller, all orders from the Customer, and all agreements between the seller and the customer related to the purchase of products via our webshop www.rubiomonocoat.be.
Unless expressly agreed otherwise in writing, the applicability of any other terms is explicitly excluded.
3. Ordering Process & Formation of the Sales Contract
The Sales Contract is concluded as soon as we, as the Seller, have accepted your order via the webshop by sending you an order confirmation by email, which includes the details of the ordered Product(s) and a copy of these General Terms and Conditions.
As the Seller, we reserve the right to refuse a placed order if:
- (i) the Product is unavailable for a long period (the Customer will be informed and refunded),
- (ii) a previously placed order was or is the subject of a dispute with the Customer.
4. Prices
The prices of the Products are those stated on the webshop at the time the order is placed. Muylle-Facon is not bound by material errors (technical or input errors). In the event of such an error, the Customer will be informed and will have 14 calendar days to withdraw from the contract.
All prices include VAT at the applicable rate in the Customer's country of residence. Prices exclude delivery costs. Before the order is effectively placed, the total price, including all taxes and costs, will be clearly stated for the Customer.
5. Payment Methods
Products must be paid for in advance at the time the order is placed. Accepted payment methods:
- Bancontact, Mastercard, Visa, PayPal, Maestro
The Customer guarantees that they are legally entitled to use these methods and that sufficient funds are available.
6. Delivery
- Products are only shipped to addresses in Belgium.
- The Seller undertakes to deliver the Products within 30 calendar days after payment, unless another delivery date has been expressly agreed. In case of delay, the Customer will be informed in writing and provided with a new reasonable delivery date. If this new deadline is also exceeded, the Customer has the right to cancel the order.
- The Seller reserves the right to make partial deliveries in case of temporary unavailability. The Customer will be informed of this.
- If delivery is delayed because the Customer unreasonably refuses to accept the Products or fails to collect them, the Seller has the right to terminate the contract.
- Delivery takes place at the address provided during the ordering process. Upon delivery, the Customer must check the packaging and products for visible defects or damage.
- Complaints regarding visible defects or non-conformity must be reported in writing within 2 days of delivery, including a clear photo. Claims submitted after this period will not be processed.
- The risk of loss or damage passes to the Customer at the moment of delivery/collection.
7. Cancellation (before shipment)
The Customer has the right to cancel the order free of charge before the Products have been shipped. After cancellation, the Customer will receive a confirmation and a refund. Once a shipping confirmation has been issued, cancellation is no longer possible, but the withdrawal procedure applies.
8. Right of Withdrawal
The Customer has the right to withdraw from the contract within 30 days without giving a reason. This can be done by:
- Sending an email to shop@rubiomonocoat.com, or
- Using the online return form or the model withdrawal form.
The withdrawal period expires 30 days after the day the Customer receives the Products. In the case of multiple products delivered separately, the period starts from the delivery of the last product.
The Customer must return the Products within 14 days of notification. The costs of the return shipment are paid by the buyer.
The Seller will refund the price and standard delivery costs (excluding extra costs for express delivery). In the case of a partial return, delivery costs will not be refunded. The refund will be made within 14 days of receipt of the goods or proof of shipment, using the same payment method. A reduction may apply for any depreciation caused by excessive use or damaged packaging.
9. Warranty
The Customer is entitled to a legal warranty of 2 years for defects manifesting from delivery. Defects must be reported within a reasonable timeframe with proof of purchase. The warranty does not apply in cases of abnormal use or failure to follow the manual.
